US H1B VISA

The H1B Visa is one of the most difficult visas to obtain. Due to the annual visa cap, there is a high demand for this visa from US employers. Furthermore, because it leads to a Green Card, it is one of the best visas for applying to work in the United States.

Successful petitioners under the H1B program may :

  • Live and Work in the United States
  • Extend your stay in the United States
  • Change employers while on H-1B Status
  • Remain in the United States with their dependent spouse and children (under the age of 21)

Validity :

  • The visa has a three-year validity period with the option of extending it for a maximum of six years.
  • When the validity period expires, a foreign worker must either leave the United States or obtain a new visa.
  • If he does not comply, he risks losing his legal status and being deported.

Required Documents :

The H1B visa is a point-based system, and you must have a minimum of 12 points for your application to be considered. You must have the following :

  • A Bachelor's or Master's degree from the United States (or an equivalent in your country)
  • Or, 12 years of work experience
  • Or, a combination of education and work experience

Visa Cost :

The current standard H1B filing fee is $460. The 1-129 petitions are subject to the standard H1B filing fee.

The H1B visa filing fee will rise by 21%, from $460 USD to $555 USD. The proposed fee increase will go into effect on October 2, 2020.

The fee can be paid electronically via bank transfer or in cash at a specific bank with branches throughout India. Then, on the US Visa Service website, create a profile and select the scheduled appointment option to ensure the correct amount is paid and the appointment is scheduled in a timely manner.

You will be presented with payment options and additional information on how to initiate payment on the payment confirmation screen. The fee is valid for a year from the date it is paid. You must schedule your visa interview within one year of receiving your visa.



US H4 VISA

A non-immigrant dependent visa is an H4 visa. The visa does not grant you permanent residency, but it does allow you to live, study, and work in the United States.

Who is eligible ?

  • Spouse of a H visa holder
  • Children under the age of 21 whose parent holds a H visa

The validity of the H4 visa

The validity of the visa is determined by the visa of the sponsor, also known as the principal applicant. The spouse or parent with the H visa usually sponsors the visa. When the sponsor's visa expires, the H4 visa becomes invalid.

Work permission for the H4 visa holder

US L-1A VISA

The L-1A Visa is a non-immigrant visa issued by the United States. The US Citizenship and Immigration Services (USCIS) issue this visa to foreign directors or managers who are being transferred to their company's U.S. offices. International companies that do not have affiliated offices in the United States may use an L-1A visa to send a manager or executive to establish one there.

The L-1A visa is one of two work visa categories in the L-1 visa category. Its equivalent, the L-1B visa, is for employees with advanced skills who wish to work in the United States for a period of five years. Upon expiration, the applicant may reapply for L-1 visa holder status only after working for the organization's parent, subsidiary, branch, or affiliate for at least one year outside the United States.

Requirements :

An L1 visa has two main requirements: employer requirements and employee requirements.

Employer Requirements :

A qualifying relationship must exist between the employer in the United States and the applicant's international branch/subsidiary/affiliate. This indicates that the two organizations are linked in some way through ownership or association.

Furthermore, the employer must be conducting business in the United States and at least one other country during the visa holder's stay in the United States.

Employee Requirements :

With an L1 visa, the applicant must have worked for the international employer for at least one year in the three years preceding their admission to the United States.

This employment must have been in an administrative, corporate, or technical field, and their future jobs in the United States must be in the same fields.

L1A Visa to Green Card :

Because an L1A visa applicant qualifies for an EB-1C Green Card, obtaining a green card is relatively simple. This does not necessitate a PERM Labor Certificate, which reduces the processing time by up to 8 months.

To qualify for the green card, the employer only needs to file an I-140 petition. If the applicant is accepted, he must file for a status adjustment (Form I-485).



US L2 VISA

L2 visas are also referred to as L1 dependent visas. Spouses and dependents of L1 visa holders are eligible for the L2 visa. L2 visas are non-immigrant visas.

L2 visa holders can :

  • Live in the United States temporarily
  • Study full-time or attend college in the United States
  • Apply for an Employment Authorization Document (EAD) in order to work in the United States.
  • Change your visa status to a non-immigrant visa such as F1, B1/B2, H1, or L1.
  • Short international trips in and out of the United States

US R1 VISA

An R1 visa is for religious workers who want to work in the United States. It is a temporary visa.

Eligibility Conditions

  • To begin, you must work part-time in the United States, which means you must work at least 20 hours per week.
  • At the same time, you must find work that is related to your religion. To put it another way, you must either work in a religious setting or serve as a minister.
  • This means that if your work is not religious, you will not be eligible for R1 Visas.
  • You are also eligible if you have a genuine religious charitable organisation, were a member of the religious community prior to applying for a visa, and served in that capacity for at least two years prior to applying for an R1 visa.
  • You can also work for an employer who is also a religious non-profit organisation in the United States.
  • You are not eligible if you are not going to work in a religious organisation or a church, or if you are not going to participate in their activities. These visas are only available to religious workers who have a job in the area.
  • Being a volunteer will also not result in an R1 visa. You must be a paid employee in order to apply.

Documents Required :

  • A Non-immigrant Visa Electronic Application Form (DS-160).
  • A valid passport for travel to the United States with a validity date at least six months beyond your intended stay.
  • A passport photograph taken within the last six months.



US R2 VISA

The R2 visa is a temporary US visa that allows an R1 visa holder's spouse and unmarried child (under the age of 21) to enter the United States. Holders of R2 status may stay in the country for as long as R1 holders have legal status. In other words, when the primary R-1 individual loses legal status, the individual loses his or her R-2 status.

R2 visa holders can :

  • Enroll in a full-time study programme in the United States;
  • Travel freely in and out of the United States during the visa's validity period; and
  • Apply for permanent residency status.

However, R2 visa holders are not permitted to work in the United States.

Here are the steps to apply for H1B visa

Read Common Non-Immigrant Visas to determine your visa type. The qualifications and application items for each visa type are explained in detail. Select the appropriate visa type for your situation.

The following step is to fill out the Non-immigrant Visa Electronic Application (DS-160). Make sure to carefully read the Guidelines for Completing the DS-160 Form. All data must be correct and up to date. You cannot make any changes to the form once it has been submitted.

Once you have completed the DS-160, you must pay the visa fee.

You must access your profile using the same credentials you used to pay your visa fee. You must schedule two appointments on the website, one for the Visa Application Centre (VAC) and one for the visa interview at the Embassy or Consulate.

Bring the necessary documents to your Visa Application Centre (VAC) appointment.

Following your visit to the Visa Application Centre to have your photo and fingerprints taken, you will proceed to the U.S. Embassy or Consulate on the date and time of your visa interview, accompanied by the necessary documents.



H1B VISA SPONSORSHIP

An employer may hire a non-immigrant for an H-1B visa to work in the United States. The worker must have a bachelor's degree (or the equivalent in their country) and the position for which they are applying must require the use of specialized skills.
